Overview of Policy
This Privacy Policy (this “Policy”) applies to you if you access and use the Fresh Bite 2 Go mobile app (the “App”) and its services, including the associated website at www.freshbitetogo.com. (collectively, the “Services”). This Policy relates to the information you may submit and the ones we automatically obtain when you access or use the App and/or associated website. This Policy does not apply to the information collected by any third party website or service, such as the food vendors.

The Services is provided under the company, 5025205 Ontario Inc. (referred herein collectively as “Fresh Bite 2 Go”). This Policy further describes all Fresh Bite 2 Go’s processing activities of the information it collects from all its users – the food vendors (the “Chefs” or “Chef”) or the food buyers (the “Consumers” or “Consumer”).

This Policy details, including without limitation: (i) how information is collected, (ii) how the information collected is used, (iii) how the information may be disclosed, (iv) how the information is secured/safeguarded, and (v) the users’ rights regarding the information. You are expected to read, understand, and consent to this Policy, our Terms and Conditions, and other agreements posted through the Services. By using the Services, which includes accessing and/or using the App and website, you hereby agree to the manner in which we process your information. If you do not agree to this Policy, you may not use the Services.

The Information Collected when you use the Services and their Uses
When you use the Services, we obtain some personal information from you, which are used to provide the App to you. This category of information may be obtained from you in two ways: it may be provided by you willingly or automatically obtained by us through some programmed software. See the classification below:

The Personal Information you willingly Provide to Fresh Bite 2 Go
Personal Information, as defined under Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”), is any factual or subjective information (whether or not recorded), about an identifiable person – in this case, you and the other App users. When you use the Services, you may be required to submit some certain personal information (whether as a Chef or Consumer), which are:

Registration and Contact Information: Registration and contact information may include your name, email address, phone number, business address, home address, picture, and other profile information. As a Chef, you may also be required to provide optional files such as diplomas, certificates, or awards related to your food business in order to prove your business. Registration information may be obtained when you open an account with Fresh Bite 2Go, complete your profile information, subscribe to our newsletter, or contact us for inquiries or issues. Registration information is used for KYC (to identify you from other users), to contact you on offers we think may interest you, and to generally provide the Services.

Payment Information: Whether you are a Chef or Consumer, you will be required to submit payment information. For example, you will be required as a Consumer to submit payment information in order for Fresh Bite 2 Go to process any payments for any food ordered from a Chef. All payments are processed through our third party service provider, Stripe.

ID Information: In order to conduct a background check and verify you, Fresh Bite 2 Go will require you to submit any government-issued ID, such as a driver’s license or passport. ID information will not be used for any other purpose other than to verify you and/or your business (if applicable). For example, we are required under applicable law to ensure a Chef is who they say they are.

Communications and Participations: We also obtain information from you when you participate in any of our programs, such as surveys, sweepstakes, and promotions. To register you for these activities, we will need to collect some information, such as your name and contact information, from you to identify and contact you.

The Personal Information Fresh Bite 2 Go Obtains Automatically
We use programmed software to automatically collect some information from you when you access the App or website. Some of this software include cookies and third party tracking tools. See more details below:

Device Information: We use cookies to obtain information about the device you are accessing the Services with. Device information may include, without limitation, your device operating system, browser type, IP address, internet service provider, and other related information. Device information is collected for security purposes.

Usage Information: We collect information about how you use the Services. Usage information may include the date and time of your access, the part or feature of the App you viewed, and the previous apps or websites you accessed before using our Services. Usage information is anonymous and does not include any personal information. We collect usage information for marketing purposes, to identify which part of the Services needs improvement, and to personalize the Services to you.

Analytics Information: When you access the App and website as a visitor, and during your subsequent visits, we will collect analytics information about your usage. We collectanalytics information through Google Analytics, a third party tracking software provided by Google Inc. Analytics information includes anonymous information about the metrics and dimensions of traffic to the Services. This information helps us identify the features mostly used and how to improve the Services. See the cookies section for more about Google Analytics and your options.

Location Information: In order to provide the Services to you, you will be required to share your location information with us. For example, we need both users to share location information to enable us to show a Consumer the Chefs near them and locate a Chef’s location when they order from them. We do not forcefully know your location when you use the Services unless you grant us permission.

How Fresh Bite 2 Go may Disclose Personal Information about you
We will not disclose or share any information about you to a third party or the public unless you expressly order us. The information we collect in section 2 above is only used for the Services and is not in any way intended to be disclosed or shared with any unauthorized third party. However, there are some uncontrollable circumstances under which we may disclose your information, and they include:

Disclosures to our Service Providers: Service Providers are third party companies who provide certain services on our behalf. For example, we employ third party services for analytics, App and website maintenance, SMS sending, marketing and advertising, payment processing, web hosting, survey conducting, etc. Some of these Service Providers need access to certain information about you to carry out their duties. For example, in order to process your payments as a Consumer, we employ Stripe for this role, and they need access to your payment information to process such payments. Meanwhile, we only allow these Service Providers to use your information for the Services. They are under an obligation – through a nondisclosure agreement – to keep your information confidential.

Disclosures under the Law: Disclosures under the law include disclosures of your information to law enforcement or courts as required under applicable law or subpoena. We may also disclose your information when we believe that such disclosures are needed to comply with the law; to enforce our Terms and Conditions and other agreements; to protect our rights and other users of the Services; to prevent or protect fraudulent actions; to safeguard our integrity.

Disclosure under Business Transfers: Business transfers refers to any activity in the line of a business changeover, including merger, consolidation, sale of an asset, bankruptcy, or acquisition of Fresh Bite 2Go. For example, if we merge with another company, we may have to disclose information about you to such a company. Any business transfer occurrence will be communicated to you through your email address, and options will be provided to you thereafter.

Disclosures at your Consent: In some instances, we may share your information with third parties for their marketing purposes. However, this will not occur unless you approve of it. Likewise, we may share information with any app, company, website, or other third parties if you expressly direct us to.

Disclosures between Users: If you interact with another user through the Services. For example, when a Consumer and a Chef enters into a contract, information about both users will be available to each other. This will enable both users to interact and understand the terms of their agreement.

Disclosures to the Public: There are certain parts of the App where you may be able to post certain content such as reviews and ratings, comments, and business pictures and information. Such content will be available to anyone who navigates to the content area. For example, if you review a Chef’s services after delivery, your account name and feedback will be visible to other users of the App, who navigates to such an area.

Cookies and Other Tracking Tools
Fresh Bite 2 Go and certain Service Providers use cookies and other tracking tools, such as Google Analytics, on the App, website, email communications, advertisements, and other services for certain purposes, including but not limited to, personalizing the Services, improving the App and website, identifying each user preferences, measuring our adverts, analyzing traffic, and understanding user behaviours. Cookies
Cookies are bits of data or information that is attached to your browser or device through a programmed software when you visit the App or website, which is used to track some information about your behaviours on the Services. The cookies may be a “First Party Cookie” (from Fresh Bite 2Go) or “Third Party Cookie” (from Service Providers). Also, cookies may be “Session,” which exists for a browsing session and expires when a user closes their browser, or “Persistent,” which exists for defined longer periods. Persistent cookies expire when their set date is up or when a user opts out of cookies before the expiry date.

Essential Cookies: This type of cookies enables you to navigate and access all features available for use on the App and website.

Performance and Analytics: This type of cookies enables Fresh Bite 2 Go to gather information about your use of the App. Performance and analytics cookies gather anonymous information about how you use the App, including how long you stay on the App, where you are accessing the App from, and the places you visited on the App. This type of cookies is used to improve and learn those functions on the App that are most used or common to the users. Personal information is not included under performance and analytics cookies; however, we might be able to link such information with each user if combined with other information.
Among other things, we use cookies to personalize the Services, improve user experience, remember user login details and other profile preferences, and analyze our marketing.


Most devices and browsers are programmed to automatically accept cookies; however, you may set your device or browser to refuse cookies or notify you of cookies when they are sent to you. This means that you may block cookies from being attached to your browser. The help section of your browser will guide you into how cookies may be blocked. However, be aware that when you block cookies, some features may not be available to you when you use the App. For example, when you block cookies, you may need to always provide your login information to log in to the App each time you wish to access your user account. You hereby become responsible for any malfunction of the App, which may be as a result of you blocking cookies.

Other Tracking Tools (Google Analytics)
We use third party tracking tools such as Google Analytics – provided by Google Inc. – to gather analytical information about the metric and dimension of traffic to the App and website. The information gathered by Google Analytics is anonymous in nature and does not identify a user. This information includes the sources of traffic to the App and website; the number of users currently on the App and the part they are on; the actions users have taken on the App; and other analytical information. Google Analytics is used to analyze marketing and tailor adverts that may interest users, and identifying the part or features of the App that needs improving.

Fresh Bite 2Go Marketing Communications
Marketing Communications refers to the occasional marketing emails that are sent to your email address and push notifications that pop up on your device when you use the App. See below for more details:

Marketing Emails: When you submit your email address to us during your sign up for the Services, your email address will automatically be added/subscribed to our marketing list, where we will occasionally send you Marketing Emails on offers, promotions, and other updates we think may match your interest. We will send you Marketing Emails for as long as you are subscribed to our marketing list. However, you may unsubscribe from receiving Marketing Emails by clicking on the “unsubscribe” link or button provided at the bottom of any Marketing Email that is sent to your email address. Marketing Emails do not include administrative emails such as upgrades to the Services, updates to this Policy or other agreements, and changes in the business model.

Push Notifications: Like Marketing Emails, Push Notifications are the occasional marketing messages that pop up randomly on your device when you install the App. Push Notifications, like Marketing Emails, also contain messages on offers, bonuses, and promotions that Fresh Bite 2Go believes may match your interest. However, you have the option to block Push Notifications on the App if you wish to. This can be done by going through the App notification settings of your device.

The Security of your Information
Fresh Bite 2 Go respects your privacy; we employ the necessary measures to ensure the information we hold about you is secured from unauthorized access or use. We do not share information about you with third parties unless you consent to it or under the circumstances discussed above. We employ the use of Twilio for SMS gateway, and for OTP verification. We also use a secured gateway, Stripe, to process your payments. However, you will agree with us that no matter how secure or sophisticated any measures employed are, they may not be enough to arrest every threat to your personal information. Although we will do everything within standards to safeguard your personal information, we cannot guarantee that only authorized persons will have access to it. Therefore, Fresh Bite 2 Go will not be liable to you for any breach of your information, which may occur from third party theft.

You also have the obligation to keep your account login details confidential at all times. Also, if you in any way believe someone is attempting to access your account, please, reach out to us immediately through our support email address at contact@freshbitetogo.com.

User Options and Choices
Under PIPEDA, you have the following options and choices, in relation to the information we hold about you:

Modification of Information: You have the right to edit or modify any personal information you submitted to us. You may exercise this right by signing in to your user account, navigating to your profile, and editing your preferences.

Deactivation of Account: You have the right to terminate your use of the Services by deactivating your user account. When you deactivate your user account, your personal information will be deleted after a year. This is to comply with applicable law and enforce our Terms and Conditions. To deactivate your user account and request for the deletion of your information, please, reach out to us via our email address at contact@freshbitetogo.com.

The International Transfer of your Information
The App and website are provided from our base of operation in Canada – where we store and process your information. However, we may contract Service Providers in other countries whose privacy laws may be different from the laws of PIPEDA, and we may share information with such Service Providers when they perform certain services for us in relation to the Services. Notwithstanding the foregoing, the sharing of your personal information to such Service Providers, will be in accordance with this Policy.

The Retention Period of your Information
Fresh Bite 2 Go will not keep any information about you for longer than is necessary. We will only keep your information in our database, for as long as you have an account with us, and you use the Services. Once you request the deactivation of your user account, we will retain certain information, such as transactional information, contact, and identity information, with us for one year. This is to prevent us from future claims and disputes.

Children Policy
The Services are intended for users who are able to form a contract. We do not knowingly obtain personal information from users who are below 18 years of age (or the minority age in any location). If you are below the majority age, we do not allow you to use the App. You may only submit information to us or use the App if you are being supervised by at least a parent or legal guardian.

Third Party Contents
The App and/or website may contain – on an occasional basis – content such as links, files, and adverts from third party websites (“Third Party Content”). Any Third Party Content that may be found on the App and/or website does not constitute our endorsement of such Third Party Contents to be safe and secure to access. For example, if you access a third party link on the App and/or website, you are responsible for any privacy you may lose thereon. This Policy does not apply to any Third Party Content found on the App and/or website. We encourage you to review the privacy policies of any third party website found on the App, and/or website, before accessing them.

California Residents Privacy Rights
If you are a California resident, California Civil Code Section 1798.3, known also as “Shine the Light” law, allows you to request from us, the personal information we have released to third parties, for their direct marketing purposes, once in a year, for free. If this section applies to you, the information concerned would be the categories of information we have shared in the immediate past calendar. Updates to this Policy
We reserve the right to review and update this Policy due to changes in applicable laws or certain features to the App, website, and generally, the Services. Any updates to this Policy will be effective when the Effective Date above changes. We may also notify you of updates to this Policy through your contact information – your submitted email address. We encourage to frequently review this Policy for updates. By your continued use of the Services after any updates to this Policy, you confirm to us that you agree with such updates.
